Terms of Service

Welcome to Prime Fairways. These Terms of Service ("Terms") form a binding agreement between you and Prime Fairways ("we", "us", or "our") and govern your use of our website, mobile experiences, and any related services (collectively, the "Service"). By creating an account, joining the waitlist, or otherwise using the Service, you accept these Terms.

If you do not agree to these Terms, do not use the Service. We may update these Terms from time to time; we will indicate the effective date above. Continued use after changes constitutes acceptance.

Prime Fairways is a monthly credit membership for golfers in the Miami-Dade region. Members purchase a subscription that includes a monthly allowance of "credits". Credits can be redeemed for tee times, driving-range bays, simulator sessions, and other golf services at partner venues that participate in the program.

We do not own or operate any golf course, range, or simulator. Partner venues are independent businesses solely responsible for the golf services they provide. Prime Fairways facilitates discovery, booking, and payment through the credit system but is not a provider of golf services itself.

You must be at least 18 years old and able to enter a binding contract under Florida law to use the Service. By creating an account you represent that the information you provide is accurate and that you will keep it up to date.

You are responsible for keeping your sign-in credentials confidential and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

The Service is currently in a pre-launch waitlist phase. Joining the waitlist is free and creates no obligation to purchase a membership when bookings open. We will email waitlist members when their preferred Miami-Dade partner venues come online.

We make no guarantee about launch dates, the specific venues that will participate, the pricing of any membership tier, or the credit cost of any specific tee time. All product descriptions on the marketing site are subject to change before launch.

When paid memberships become available, the following will apply:

• Monthly subscription. Memberships bill monthly in advance via the payment method on file. You authorize us to charge the listed amount each cycle until you cancel.
• Credit issuance. Credits are issued on each successful billing and represent a promise to facilitate booking at participating venues. Credits have no cash value and cannot be exchanged for currency.
• Rollover. Unused credits roll over while your membership is active, up to a maximum stored balance equal to two months of your plan's monthly credits. Credits above that cap are forfeited at the next renewal. If you cancel, unused credits remain usable until the end of your current billing cycle, then expire.
• Credit cost per slot. The number of credits required for any specific tee time, range bay, or simulator session varies by venue, day of week, and hour of day. The cost shown at the time of booking is the cost that applies.
• Cancellation. You may cancel anytime from your account settings. Cancellation stops future billing; we do not pro-rate or refund credits for the current cycle.
• No refunds on used credits. Credits that have been redeemed for a booking are non-refundable except where required by law or by a partner's posted cancellation policy.

Each partner venue maintains its own cancellation, no-show, dress code, and conduct policies, which apply when you visit. You agree to comply with those policies and to treat partner staff respectfully.

We are not responsible for service interruptions, course closures, weather, the quality of play, instruction, or any other aspect of the experience at a partner venue. Disputes about the on-site experience should be raised first with the venue.

The referral program is not active during the beta — it launches with our public release. Once it's live: when you refer a friend through your unique invite link and they sign up and complete their first booking, both accounts may receive bonus credits. We may change the reward amount or program structure at any time, and self-referrals, fraudulent referrals, and referrals that violate these Terms are not eligible.

You agree not to:

• resell, share, or sublicense your account or any credits;
• use the Service to harass, defraud, or harm anyone;
• attempt to bypass rate limits, scrape, or reverse-engineer the Service;
• upload content that is unlawful, defamatory, or infringes others' rights.

The Prime Fairways name, logo, site design, and software are our property and protected by U.S. and international intellectual-property laws. You receive a limited, revocable, non-exclusive license to use the Service for its intended purpose only.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or available at any specific venue at any specific time.

To the maximum extent permitted by law, Prime Fairways and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or use, arising out of or related to the Service. Our total aggregate liability for any claim will not exceed the amount you paid to Prime Fairways in the 12 months before the event giving rise to the claim.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction.
